These Terms of Service (“Terms”) govern your access to and use of www.miknik.in (the “Website”) and any purchase made through it. The Website and the Miknik brand are operated by Mala Ram Sons (“Miknik”, “we”, “us” or “our”).

By accessing the Website, creating an account or placing an order, you agree to these Terms, our Privacy Policy, Refund Policy and any other policy displayed on the Website. If you do not agree, please do not use the Website.

Nothing in these Terms limits any right or remedy that cannot be excluded under applicable Indian law.

1. Eligibility

You must be legally capable of entering into a binding contract to place an order independently. If you are under 18 years of age, please use the Website and place orders only with the involvement and consent of a parent or lawful guardian.

If you use the Website on behalf of a business or another person, you confirm that you are authorised to accept these Terms on their behalf.

2. Accounts and Customer Information

You may be able to browse or purchase products as a guest or through a customer account, depending on the features available.

You agree to:

  • provide complete and accurate contact, billing and delivery information;

  • keep your account information updated;

  • protect your password, OTP and other account credentials;

  • not allow unauthorised use of your account; and

  • notify us promptly if you suspect unauthorised access.

You are responsible for activity carried out through your account unless caused by our failure to use reasonable security measures. We may suspend or restrict an account where reasonably necessary to prevent fraud, misuse or harm.

3. Product Information

We try to display product descriptions, ingredients, quantities, prices and images accurately. However:

  • screen settings may cause minor colour differences;

  • confectionery products may have reasonable variations in colour, size, shape or appearance;

  • packaging designs may be updated from time to time; and

  • minor differences that do not materially change the product may occur.

The product name, net quantity, ingredients, allergen information, nutritional information, storage instructions, manufacturing details and best-before or expiry information printed on the delivered package should be checked before consumption.

If you have an allergy, intolerance, medical condition or specific dietary requirement, carefully review the product label and contact us before ordering if clarification is needed. Product information on the Website is general information and is not medical advice.

4. Prices, Taxes and Offers

  • Product prices are displayed in Indian Rupees unless stated otherwise.

  • The total amount payable, including applicable taxes and delivery or other disclosed charges, will be shown before you confirm the order.

  • Prices, discounts, bundles, coupons and promotional offers may change without prior notice, but a change will not affect an order already accepted by us.

  • Offers may be subject to specific eligibility conditions, validity periods, product exclusions, minimum order values or usage limits.

  • Unless expressly stated otherwise, promotional codes cannot be combined.

If a product is listed at an obviously incorrect price or with incorrect information because of a technical or human error, we may contact you for instructions or cancel the affected item before dispatch. Any amount already paid for a cancelled item will be refunded.

5. Orders and Acceptance

Adding an item to the cart does not reserve it. When you complete the checkout through an explicit action such as selecting “Place Order” or “Pay Now”, you submit an offer to purchase the selected products.

An order confirmation acknowledges that we have received your order. The order is accepted when we dispatch it or otherwise expressly confirm acceptance.

We may reasonably reject, limit or cancel an order before dispatch because of:

  • product unavailability;

  • incorrect pricing or product information;

  • payment failure or verification issues;

  • delivery restrictions;

  • suspected fraud, misuse or unauthorised commercial activity;

  • unusually large quantities; or

  • circumstances outside our reasonable control.

If we cancel a prepaid order or item, the corresponding amount will be refunded. We do not charge a separate cancellation fee.

6. Payment

Available payment methods will be shown at checkout and may include online payment methods or Cash on Delivery in eligible locations.

Online payments are processed by third-party payment service providers. Their terms and privacy practices may also apply. We generally do not receive or store complete card, UPI or banking credentials.

You confirm that you are authorised to use the selected payment method. We may delay or cancel an order if payment is not completed, is reversed or cannot be verified.

7. Shipping and Delivery

Delivery availability, estimated timelines and charges are described on the Website or shown during checkout.

Delivery dates are estimates unless expressly stated otherwise. Delays may occur because of courier operations, weather, public holidays, government restrictions, incorrect addresses, remote locations or other circumstances outside our reasonable control.

You are responsible for:

  • providing a complete and serviceable delivery address;

  • providing an active contact number;

  • ensuring that someone is available to receive the order; and

  • checking the package for visible damage or tampering at delivery.

Ownership of the products passes to you after full payment and delivery, subject to applicable law. The risk of loss or damage passes when the order is delivered to you or a person authorised by you.

Your rights regarding failed, delayed, damaged or incorrect deliveries are described in our Refund Policy.

8. Cancellations, Returns and Refunds

Food products are generally not returnable after delivery for a change of mind, taste preference or similar reason because they cannot safely be restocked.

This restriction does not apply to products that are damaged, defective, unsafe, expired, incorrect, spurious, materially different from their description or otherwise eligible for a remedy under applicable law.

Cancellation, replacement and refund eligibility, reporting requirements and timelines are set out in our Refund Policy, which forms part of these Terms.

9. Food Safety and Storage

You should:

  • inspect the seal and packaging before consumption;

  • follow the storage and usage instructions printed on the package;

  • not consume a product that appears tampered with, damaged, contaminated or unsafe;

  • consume the product before its stated best-before or expiry date; and

  • keep products away from conditions that may affect their quality, including excessive heat, sunlight, moisture or pests.

If you suspect a genuine product-safety issue, stop using the product, keep the package and batch details, and contact us promptly.

10. Reviews, Feedback and User Content

If you submit a review, image, feedback, suggestion or other content, you confirm that:

  • it is based on your genuine experience or is otherwise truthful;

  • you own it or have permission to submit it;

  • it does not violate another person’s privacy, intellectual-property or other rights; and

  • it is not unlawful, abusive, misleading, defamatory, obscene, fraudulent or harmful.

You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt and display submitted content for operating, improving and promoting Miknik, subject to our Privacy Policy and applicable law.

We may moderate or remove content that violates these Terms, but we are not required to publish every submission.

11. Intellectual Property

The Website and its content—including the Miknik name, logo, mascot, artwork, packaging designs, product photographs, text, graphics, videos and Website layout—are owned by or licensed to Mala Ram Sons and are protected by applicable intellectual-property laws.

You may use the Website only for personal, lawful shopping and information purposes. You may not copy, reproduce, modify, distribute, commercially exploit or use our intellectual property without prior written permission.

No right or licence is granted except the limited right to access and use the Website in accordance with these Terms.

12. Prohibited Uses

You must not:

  • use the Website for an unlawful, fraudulent or harmful purpose;

  • provide false information or impersonate another person;

  • interfere with the Website’s operation or security;

  • attempt unauthorised access to an account, system or data;

  • upload viruses, malicious code or automated scraping tools;

  • misuse promotions, coupons, refunds or payment systems;

  • place orders using stolen or unauthorised payment information;

  • infringe our rights or the rights of another person; or

  • use Website content or customer information for unsolicited marketing.

We may suspend access, cancel affected orders or take appropriate legal action where these restrictions are violated.

13. Third-Party Services and Links

Our store may be hosted or supported by Shopify and may use third-party services for payments, analytics, communications, customer support, advertising and delivery.

The Website may also contain links to third-party websites or social-media platforms. Third parties operate independently and may apply their own terms and privacy policies. We are not responsible for third-party content or practices, except to the extent responsibility cannot be excluded under law.

14. Website Availability

We aim to keep the Website accurate, secure and available, but we do not guarantee uninterrupted or error-free access. We may update, suspend or discontinue a Website feature for maintenance, security, operational or legal reasons.

We are not responsible for temporary unavailability caused by internet failures, service providers, maintenance, cyber incidents or events outside our reasonable control, except where liability cannot be excluded by law.

15. Disclaimer and Limitation of Liability

To the maximum extent permitted by law:

  • the Website is provided on an “as available” basis;

  • we do not guarantee that every Website feature will always be available or free from minor errors; and

  • Miknik will not be liable for indirect, incidental or consequential loss arising solely from Website use where such loss was not reasonably foreseeable.

Nothing in these Terms excludes or limits liability for unsafe or defective food, fraud, wilful misconduct, gross negligence, personal injury, breach of a mandatory statutory duty or any consumer right that cannot lawfully be excluded.

Where liability may lawfully be limited, our aggregate liability arising from a particular order will not exceed the amount paid for that order.

16. Indemnity

To the extent permitted by law, you agree to compensate Mala Ram Sons for direct losses, claims or reasonable costs caused by your unlawful misuse of the Website, deliberate violation of these Terms or infringement of another person’s rights.

This clause does not apply to losses caused by Miknik or impose responsibility that cannot lawfully be placed on a consumer.

17. Suspension and Termination

You may stop using the Website at any time. We may suspend or terminate access where reasonably necessary because of unlawful conduct, fraud, security risk, repeated misuse or a material breach of these Terms.

Termination will not affect rights or obligations that arose before termination, including payment obligations, accepted orders and provisions intended to survive termination.

18. Electronic Communications

When you place an order, create an account or contact us electronically, you consent to receive transaction-related communications electronically, including order confirmations, invoices, delivery updates, security notices and support messages.

Promotional communications are governed by your marketing choices and our Privacy Policy. You may opt out of promotional messages without stopping essential order-related communications.

19. Force Majeure

We will not be responsible for delay or failure caused by events beyond our reasonable control, such as natural disasters, severe weather, epidemics, strikes, transport disruption, government action, civil disturbance, utility failure or widespread internet or payment-system interruption.

We will take reasonable steps to reduce the effect of such events and provide any remedy required by applicable law.

20. Governing Law and Disputes

These Terms are governed by the laws of India.

Please contact us first so that we can try to resolve any concern promptly. Subject to any mandatory consumer forum, commission or other jurisdiction available under applicable law, courts located in Hisar, Haryana will have jurisdiction over disputes relating to these Terms or the Website.

21. Changes to These Terms

We may update these Terms to reflect changes in our Website, services, business practices or legal obligations. The revised Terms will be posted on this page with an updated “Last updated” date.

Changes will apply prospectively and will not unfairly reduce rights relating to an order already accepted.

22. General Provisions

  • If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue to apply.

  • A delay in enforcing a right does not waive that right.

  • We may transfer our rights or obligations as part of a genuine merger, restructuring or sale of the business, subject to applicable law.

  • These Terms, together with the policies referred to in them and the information shown at checkout, form the agreement relating to your use of the Website and purchases made through it.
